Reclaiming Your Mexican Heritage: A Guide for U.S. Citizens of Mexican Descent

Mexican Nationality by Birth in Mexican Territory 

Under Mexican law, a person is granted Mexican nationality by birth if they are born in Mexican territory. But what exactly is considered “Mexican territory”? 

According to the Mexican Constitution, Mexican territory includes:

✓ The entire land area of the country (including all 32 states and Mexico City)
National airspace
Mexican territorial waters, including rivers, lakes, and coastal zones
Mexican-flagged vessels and aircraft, whether military or commercial, even if they are outside Mexico’s physical borders

This means that a child born on Mexican soil, on a plane flying over Mexico, or on a Mexican ship or aircraft anywhere in the world is considered Mexican by birth. 

This interpretation follows the principle of jus soli (right of the soil), which grants nationality based on place of birth rather than parentage. 

Mexican Nationality by Descent 

Mexico recognizes individuals born abroad to Mexican parents as nationals by descent. This principle allows the children of Mexican citizens—regardless of their place of birth—to claim Mexican nationality. 

Importantly, this right is not limited by age; adults can also pursue recognition of their nationality.
However, it is not granted automatically. The individual must be registered either at a Mexican consulate abroad or at the Civil Registry in Mexico to obtain official recognition of their nationality. 

Eligibility Criteria 

To qualify for Mexican nationality by descent, you must:

✓ Have at least one parent who is a Mexican citizen.
✓ Provide documentation proving your parent’s Mexican nationality, such as a birth certificate and passport.
✓ Present your own birth certificate and valid identification.

If your Mexican parent is deceased, you can still apply, provided you have the necessary documentation to establish their nationality.
